Wichita Falls DWI Attorney

There may have been a time when a person facing drunk driving charges in Texas could navigate the criminal justice system without a lawyer and still come out with minimal impact on his or her life, but that time has long since passed. The penalties for driving while intoxicated (DWI) are too stiff and too strictly enforced to face an arrest without experienced legal counsel.

Texas law states that a person is legally intoxicated if he or she has a blood or breath alcohol concentration (BAC) of .08 or higher. A first conviction of DWI is punishable by a fine of up to $2,000, three to 180 days in jail and suspension of your license for up to a year. A second conviction could lead to a year in jail and loss of your license for two years. The penalties escalate dramatically for more than two convictions, as well as for drunk driving arrests that involve accidents in which someone was injured or if a person is driving intoxicated with a child in the vehicle.

Texas has a "zero tolerance" policy for minors and alcohol. If a person under age 21 is stopped while driving a motor vehicle with any detectable amount of alcohol, he or she can be charged with driving under the influence (DUI). Penalties may include license suspension and a $500 fine.

Minimizing The Impact Of A DWI Arrest

In addition to the fines, court costs and other penalties that come with a DWI conviction (including higher insurance rates), the state of Texas imposes a surcharge under the "Driver Responsibility Act" that requires drivers who are convicted of a first-time DWI to pay $1,000 per year for three consecutive years in order to keep their licenses. Drivers convicted of a second DWI will pay $1,500 per year for three years. Drivers who are convicted of a third DWI, or who are convicted of a single incident of driving with a BAC of .16 or higher, must pay $2,000 per year for three years.
